Our Services
The Court of Arbitration of our Chamber of Commerce has a centuries long tradition, going back to the roots of self-governance by Hanseatic businessmen. Nowadays, our Chamber of Commerce offers the full range of ADR procedures. Arbitration, mediation, conciliation services and publicly appointed experts are available. Our Arbitration and Mediation Division advises and supports businesspeople in the selection and productive application of the various dispute resolution mechanisms.
Our Governing Structures
Our Chamber of Commerce is a public law body. Membership for all commercial businesses in the state of Hamburg is mandatory. Our supreme policy-making body is the plenary assembly comprising 67 elected representatives of the Hamburg business community. Our Chamber is formally represented by the President and the Chief Executive Officer. Daily business is run by about 300 employees. The Arbitration and Mediation division is headed by the Legal Director.
Our Arbitration Rules
The Rules of the Court of Arbitration of the Hamburg Chamber of Commerce offer proceedings using standard administration via E-Mail and postal services. A single arbitrator decides cases up to a value of 25.000 €. Higher value cases are decided by a three-arbitrator panel. The parties can of course agree on different value thresholds. The appointment of arbitrators in case of non-agreement of the parties is undertaken by our Chamber. The entire proceedings are supported in organizational terms by our Arbitration Division. A legal officer of our Chamber participates in the proceedings in an advisory capacity. This ensures that the legal and economic knowledge of our Chamber is always available to the parties and arbitrators.
The recommended arbitration clause is: “Any dispute arising in connection with the present contract [exact description of the Contract] or with respect to its validity shall be finally settled by the Court of Arbitration of the Hamburg Chamber of Commerce, to the exclusion of the ordinary courts of law.”
Our Chamber also offers digitally based proceedings using the secure electronic procedural management platform of the Arbitration Court at the German Chamber of Commerce and Industry (SGH). The value threshold for a decision by a single arbitrator in these proceedings is 250.000 €, subject to different agreement by the parties.
The recommended arbitration clause is “All disputes arising out of or in connection with this contract or its validity shall be finally settled under the Rules of Arbitration of the Court of Arbitration at the German Chamber of Industry and Commerce without recourse to the ordinary courts of law. The arbitral proceedings are administered by the Hamburg Chamber of Commerce”.
Our Mediation Rules and other
Our Chamber of Commerce operates the Hamburg Business Mediation Centre, which is also supported by the Hamburg Bar Association and the Hamburg Mediation Institute. The Centre supports business people in business conflicts with information about mediation. It provides the Hamburg Business Mediation Rules (Hamburg Mediation Rules) and a list of highly qualified business mediators. In contracts, we recommend the following mediation clause: ”The parties undertake, in the event of a dispute arising out of this contract, to conduct mediation pursuant to the Hamburg rules of mediation for economic disputes prior to lodging an action before the ordinary courts or court of arbitration.” The Mediation Rules can be found here:
