Joint Quality Standards

Appointment by a separate body or person

The procedural rules of all AfGAC-institutions allow that the users determine a separate body or person as appointing authority. If so agreed by the parties of the dispute, the separate body or person acts as appointing authority whereas the institutions administer the case.[1]

Scrutiny of awards

The procedural rules of all AfGAC-institutions oblige[2] the arbitral tribunal to submit awards to the Secretariat for scrutiny. The Secretariat may recommend modifications as to the form of the award and, without affecting the arbitral tribunal’s liberty of decision, may also draw its attention to points of substance. No award shall be rendered and signed by the arbitral tribunal until it has been approved by the Secretariat of the institutions as to its form.

Arbitrators list

Choosing the right arbitrator is one of the most important decisions parties make in the dispute resolution process. Parties need arbitrators who understand the intricacies, vulnerabilities, and variances of their cases and industries. The AfGAC-institutions have adopted minimum standards for the creation of arbitrator lists. These lists are electronically available[3] to allow the users an informed choice in different jurisdictions.

Promotion of women and young lawyers

The AfGAC-institutions are committed to joint requirements for encouraging women and young lawyers into the stream of arbitration disputes. They have created and are applying action standards[4] as a matter of policy in arbitrations but in consideration of the wishes of the parties.

Publication of awards

Accountability and transparency are key for the creation of trust in arbitration. The publication of awards is one of the best ways to demonstrate that arbitration is not a vehicle for fraud and circumvention of mandatory rules but a serious, transparent and reliable means of dispute resolution. The AfGAC-institutions aim to publish awards, thereby however always respecting the parties’ legal rights to do or refrain to do so.[5]

Technology facilities for filing and online hearings

The AfGAC-institutions are committed to high standards as regards the online-filing of cases as well as regards case management’s software and online hearing facilities. The institutions have agreed on targets for technology advancement which are attractive for their users.
